Jesus is not a legal servant, seeing as he is full god. Full man too but also full god. The grail is not capable of summoning him.

I'm sure Jesus wasn't drinking out of an Einzbern. This grail is a fake grail. As Kotomine puts it, they don't care whether it is the original holy grail or not as long as it does what they want it to do. So they call it real but it isn't Jesus' holy grail.

A few, I think. Mosaic's master will probably be the last one, though. The servants are just about done, just a little scratch work balancing here and there.
